V) Appeals and complaints consideration
1. Appeals consideration
1.1 In case of disagreement between certification participants on various issues of certification process, the applicant has a right to apply to the CA QMS Appeal committee.
1.2 Contents of the documents submitted along with the appeal is defined by the appealing organization depending on the subject of disagreement according to the requirements of GOST R ISO 10002-2007 (Enterprise management. Customer satisfaction. Complaint management guide). Customer satisfaction. Complaints management guidance in organizations)
Appeal committee may require additional documents from the appealing organization necessary for making decisions on disputable issues.
1.3 The appeal is reviewed by the Director of QMS CA and is forwarded through documentation controller to the Chairman of the Appeal committee. Documentation controller registers the appeal (act) in the journal of incoming correspondence (if cover letter is presented) and in the Register of defects claims.
1.4 Chairman of the Appeal committee chooses members of the committee from the authorized list of colleagues and organizes:
- work of the committee, including first review of the submitted appeal, setting a deadline for resolving disputable issues (but not more than 20 days after receiving the appeal) and providing the appealing organization with information about it;
- recruiting qualified independent expertsand specialists on the disputable issue (if needed);
- discussing the merit of the appeal with either of the arguing parties (if needed);
- review of the appeal during the committee meeting with both parties invited as observers.
1.5 If needed, the Appeal committee decides upon the membership of a working committee, which makes a review at the organization of all the circumstances leading to the disputable issue.
The committee cannot include specialists who have taken part in the preparing and justification of the disputable issue or specialists who participated in organization audit.
1.6 The Appeal committee decides upon the appeals (by the simple majority of votes). The decision is in the form of protocol of optional form, which is approved by the chairman of the committee and sent to the appealing organization. The second copy of the protocol remains in the CA QMS archive.
1.7 If the decision of the Appeal committee during a month since its acceptance has not met an objection from the appealing organization, it is considered as accepted.
1.8 If the appealing organization does not approve the decision of the committee it may, having informed the Appeal committee,make an appeal to the Appeal committee of the Governing body.
The decision of the Appeal committee is considered final.

2. Complaints consideration
2.1 In case of complaints the executive director forms a working group from the CA QMS personnel.
2.2 The working group performs an analysis of the complaint according to requirements of GOST R ISO 10002-2007.
2.3. The working group is responsible for collecting and verification of all the information necessary for the justification of the complaint.
2.4 The process of complaint consideration includes following stages:
- receiving, verification, examination of the complaint, as well as deciding upon the reciprocal measures to be taken;
- maintaining and registering of complaints, including reciprocal measures;
- ensuring of correction and correction measures.
2.5 Requirements of discretion is applied in complaint consideration process in the part related to the applicant and the subject of the complaint.
2.6 If the complaint is related to the certificate holder, its consideration process checks the effectiveness of the certified QM.
2.7 During 3 days the certification authority sends to the certificate holder complaint related to them.
2.8 If the complaint analysis proves that the appealer has interpreted the CA actions wrongly or if actions leading to withdrawal of the complaint may lead to breaching the requirements of the CA QMS and VCR GOST R documentation, then the appealer receives the explanation of the issue.
2.9 Certification authority officially informs the appealer about the end of its consideration process and the decision made.
2.10 Certification authority together with the certificate holder and appealer determines whether the subject of the complaint should be disclosed and to what extent.
